By accessing or using Zanosa (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by Alphawk Dev LLC ("we," "us," or "our").
2. Description of Service
Zanosa is a fitness coaching platform that connects athletes with their coaches. The Service includes a mobile application (iOS and Android) and a website at zanosa.life. Features include workout programming, progress tracking, health data integration, nutrition logging, in-app messaging, check-ins, and coach analytics.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are limited to one account per person.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
4. User Conduct
You agree not to:
- Harass, threaten, or abuse other users
- Share harmful, offensive, or illegal content
- Reverse engineer, decompile, or disassemble any part of the Service
- Attempt to gain unauthorized access to the Service or its systems
- Use the Service for any illegal purpose
- Scrape, crawl, or use automated tools to extract data from the Service
- Impersonate another person or entity
5. Coach-Athlete Relationship
Zanosa facilitates the connection between coaches and athletes but is not a party to the coaching relationship. Coaches using Zanosa are independent professionals. We do not vet, certify, or endorse any coach on the platform. Zanosa is not liable for any coaching advice, programs, or recommendations provided by coaches through the Service.
6. Content Ownership
- Your content: User-generated content (photos, messages, data) remains your property. You grant Zanosa a limited license to store, process, and display your content as necessary to provide the Service.
- Coach content: Workout programs and training plans created by coaches are the coach's intellectual property.
- Our content: The Zanosa brand, logo, app design, and website are the intellectual property of Alphawk Dev LLC.
7. Health Disclaimer
Zanosa is not a medical service. The health and fitness data displayed in the app is for informational purposes only. Always consult a qualified healthcare professional before starting or modifying any exercise or nutrition program. Zanosa is not FDA-approved and does not diagnose, treat, cure, or prevent any disease or medical condition.
8. Intellectual Property
The Zanosa name, logo, visual design, and all related trademarks are the property of Alphawk Dev LLC. You may not use our intellectual property without prior written permission.
9. Termination
- We may suspend or terminate your account if you violate these terms.
- You may delete your account at any time through the app settings or by contacting support.
- Upon termination, your right to use the Service ceases immediately.
- Provisions that by their nature should survive termination will survive (including liability limitations, indemnification, and dispute resolution).
10. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Alphawk Dev LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
12. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via in-app notification or email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
